TERMS AND CONDITIONS

1- Information about the prize and how to enter forms part of these terms and conditions of entry. Entry into this promotion is deemed acceptance of these terms and conditions of entry by each entrant.

2- Entry is open to residents of NSW, QLD and VIC aged 18 years or older, who are OzClub members.

3- The Promoter is Ozcar Pty Ltd, ABN 98052221299, 229 Hume Highway, Lansvale, NSW 2166 Phone number 02 9794 2500.

4- Employees of the Promoter, their immediate families and suppliers, associated companies and agencies are not permitted to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

5- For clarity, an entrant does not need to buy a car to register to become an OzClub member.

Promotional Period

6- Entries into the promotion open on 22nd March 2024  and close at 12 pm AEDST on 19th April 2024  (“Promotional Period”).   

7- To receive an automatic entry into the draws, individuals must be an existing OzClub member or sign up to become an OzClub member during the Promotional Period. To sign-up and become a OzClub member individuals can visit ozcar.com.au/ozclub, follow the prompts to the sign-up page, input the requested details (including first name, last name, date of birth, contact number, email) and submit the fully completed form.

Selection of Prize Winner

8- The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

9- If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

10- Incomplete or indecipherable entries will be deemed invalid.

11- The Promoter’s decision is final and no correspondence will be entered into.
 

12- There will be one (1) draw conducted for entries received each week of the Promotional Period, (“Weekly Draws”). Entries into each Weekly Draw will open at 12.01pm (AEDST) the week preceding the relevant Weekly draw and will close 11:59am (AEDST) on the day of the draw. All draws will take place at 229 Hume Hwy, Lansvale NSW 2166 at 12:00am AEDST, with the first Weekly Draw taking place on 29/03/2024 and the last Weekly Draw taking place on 19/4/2024. All non-winning entries from each Weekly Draw will be entered into any subsequent Weekly Draws. Winners will be notified by email and SMS within two (2) business days of the relevant draw.

13- The first specified number of valid entries drawn in each Daily Draw will each win the prize stated in the draw schedule below. The most valuable prizes will be awarded first.
 

14- Limited to one (1) entry per OzClub member.
 

15- Limited to one (1) prize per person per Promotional Period.
 

16- The winner must reply to the winning confirmation email with their mailing address to receive a prize. The prize will be mailed to the winner within thirty (30) days of receiving their address. If prize is not in stock, it will be delivered once it has arrived.
 

Prize Details

17- Subject to the unclaimed prize draw clause, if for any reason a winner does not take / redeem a prize by the time stipulated by the Promoter, then the prize will be forfeited.
 

18- In the event the prize is not available due to supply shortages, a prize of equal value and/or specification will be supplemented as a replacement at the Promoter’s discretion, subject to any written directions from a regulatory authority.
 

19- The Prize Winner must take the prize as offered or supplemented.
 

20- The prize is non-refundable, transferrable, cannot be sold or exchanged for cash and cannot be used in conjunction with any other offer.
 

21- There will be a total of 120 prizes to be won, valued at up to $20,000

22- A draw for any unclaimed prizes may take place within 14 days of the initial draw date at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified in writing within two (2) business days of the draw. 

23- By filling in the OzClub Registration form you accept the Promoter’s Terms & Conditions and will be automatically subscribed to the Promoter’s email list. To unsubscribe reply to the email/SMS or call 9794 2500 Customer Service during business hours.
 

General

24- If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to pandemic, technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
 

25- Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
 

26- Entrants consent to the Promoter using their name, suburb or residence, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
 

27- Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
 

28- Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorized access or third party interference; (c) any entry,  prize or reward that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize or reward value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner, entrant; or (f) use of a prize or reward.
 

29- The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.ozcar.com.au/content/ozcar-privacy-policy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about the way in which their privacy has been handled and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose PI to any entity outside of Australia.
